Who is Responsible for the Processing of your Personal Data?
This Privacy Policy governs the processing of your personal data through the Forma Health application (hereinafter, the "App") and the website "https://forma.health/" (hereinafter, the "Web"). The App and the Web are owned by Forma Health Technologies SL. (hereinafter "Forma Health" or "we") with registered office at C/ Vilana,12, Centro Médico Teknon Barcelona, 08022 Barcelona, with CIF B44580835, responsible for the collection and processing of your personal data.
We are fully committed to compliance with data protection regulations, and for this reason, we have designated a Data Protection Officer for Forma Health, whose contact email is [email protected].
What Personal Data do we Collect and Process?
As explained in our Terms and Conditions, to enjoy our services, both on the App and the Web, you will need to register as a user. When registering, we will need you to provide your age. Please note that if you are under 14 years of age, we will need your parents' or legal guardian's permission. In the event of not obtaining such authorization, you will not be able to use the App or Web (the references included in this Privacy Policy will also apply to parents/legal guardians if you are under fourteen (14) years old).
Once we have obtained this information and/or, as applicable, the corresponding permissions, you will need to provide your phone number, through which we will send you an activation code.
After confirming the activation code, we will ask for your name, email, consent for us to access Apple Health, Google Fit, or a similar application's data, and if access is not granted, we will ask for your height, weight, biological sex, information about any injuries you may have suffered, the type of surface you typically play on, tournaments you participate in annually, hours of court training per week, and hours of physical preparation per week.
Once you have provided us with this information, you can access the main menu, where you will find various types of content and information related to the world of tennis and health. Please note that not all the information we request when you register is mandatory. However, the more information you provide, the better we can tailor your profile to your interests.
The personal data we will process is divided into three categories, each of which includes different types of data, some of which are necessary and others voluntary:
Data you provide both at the time of registration and during the use of the App and/or Web or in subsequent communications.
Identifying Information: name, last name, profile name, email, date of birth, and mobile phone number, image, and voice.
Geolocation Data: GPS, IP address, device location data. Geolocation activation will be requested via the mobile phone. We will only have access to this information with your prior consent.
Physical and Health Data (Medical History): height, weight, injury history, and health-related habits (e.g., number of workouts, sleep quality, etc.). This data may be collected through questionnaires within the App/Web or other health-related questionnaires when you voluntarily choose to participate/respond.
Financial Data: In the App, we may collect your financial data, such as bank account details (bank account number), credit card, billing email address, VAT, and information about payments you have made for the services we provide.
On our Web, we may collect your financial data, such as the billing contact email address, VAT number, and information about payments you have made for the services we provide. Other financial data, such as credit card data, will be collected directly by our payment processor, Stripe or a similar service, which will process this data as data controllers in accordance with their privacy policy. We will not have access to this data.
Data we automatically collect when you use the App or Web:
Device and Browsing Data: browsing and usage data. This data may include device model, operating system, battery level, App version, browser, mobile network, and identifying data of your device. For example, we may collect information through cookies (to see which cookies we use, you can refer to our Cookies Policy).
Data Related to the Use of the App and Web: we may use data collected from all screens of the App and Web to understand the most and least used features, as well as any issues encountered and potential improvements.
